Article 142-Reduction of sentence, where minimum sentence is prescribed - Impermissibility
Where minimum sentence is provided, reiterated, sentence cannot be reduced to period already undergone in custody, below such Minimum - However, considering age and ailments of accused, sentence of 2 yrs for offence under S. 13(1)(d) r/w S. 13(2), PC Act reduced to 1 yr (the statutory minimum) - However, sentence of one year for offences under S. 7, PC Act and fine of Rs 10,000 and in default to undergo imprisonment for 2 months maintained - Fine of Rs 15,000 for offences under S. 13(1)(d) r/w S. 13(2), PC Act and in default to undergo RI for 3 months also maintained.
