Both the accused convicted & sentenced to simple imprisonment till raising of the court and to pay fine of Rs. 1,000/- - Whether the sentence imposed by the trial Court calls for interference in this appeal? - learned Megistrate not assigned reasons much less adequate or special reasons to impose sentence of imprisonment for a term of less than 1year which is minimum sentence prescribed under Section 27(d) of the Act - as per the provisions of section 27(d), the Magistrate empowered to impose fine & find out as to whether there is adequate and special reasons for not imposing minimum sentence - sentence order imposed on the respondents under section 27(d) set aside - matter remitted back to the trial court for fresh consideration of the question of the sentence - appeal disposed of.
