Price fixing orders—In challenge
Two analogous insulin could be classified as insulin simplicitor - the petitioners developed a pharmaceutical product claiming that both the drugs are analogue of Human Insulin—the first respondent found the petitioners selling the insulin analogue formulation without obtaining the price approved by the first respondent and, thus , directed the petitioners to submit Form No. III application for price approval of the insulin analogue formulation by specified date, but, however before submission of Form III, the impugned order is passed, fixing the price of the drugs—petitions filed—the High Court held that for the purpose of ascertaining whether the said two analogous insulin could be classified as insulin simplicitor, they doing the same job, whether they can be included in the schedule and comes within the purview of the first respondent as well as the DPCO—the first respondent is directed to reconsider the entire issue of fixing the price and also whether both, the insulin and analogue insulin are one the same—petition disposed—directions issued.
