Drugs and Cosmetics Rules, 1945
Licence – expiry of – writ petition
Licence – expiry of – writ petition
issue of writ of mandamus or any other appropriate writ, order or direction - directing the respondents 1, 2 and 3 not to cancel or suspend the licence granted to the petitioners firms for sale, distribution and storage of drugs and allied products till the expiry or the validity of Ext.P2 series that is upto 31.12.2006 and respectively the drugs licence Numbers 0448/20B/NZp/93 and 0440/21B/NZ/93 dated 19.6.93 held by the petitioner expired on 10.9.2002. Rule 66 of the Drugs & Cosmetics Rules 1945 do not apply since this event is not a case of cancellation or suspension of the drugs licences—thus unless the petitioners possess the required statutory licence, they can not be permitted to run the medical shop. Writ petition is hence dismissed.
