The pendency of litigation cannot be a ground to deny the licence - the respondent did not recommend the issuance of the licence on the ground that there were litigations between the landlord and the tenant—hence, the petition—the pendency of litigation cannot be a ground to deny the licence—the High Court held that the very basis for non-consideration of the claim of the petitioner, is no more in existence, as the petition for eviction under the Rent Act, stood dismissed—impugned order set aside and the matter remitted back to the 1st respondent, to consider the application of the petitioner—petition disposed—no costs.
