Neither does the impugned order specify the reasons for cancellation of the licence nor any discussion as to why the licence as a whole which relates to several drugs, has been cancelled - Total violation of – the Central Drug Laboratory reported that the samples of Ofloxacin Infusion manufactured by the petitioner company was not found to be of standard quality—licence granted to the petitioner under the provisions of Drugs and Cosmetics Act, 1940 and the Rules thereunder was cancelled—writ application filed – no sho cause notice issued to the petitioner before cancelling the licence which is the mandatory procedure and neither does the impugned order specify the reasons for cancellation of the licence nor any discussion as to why the licence as a whole which relates to several drugs, has been cancelled or even indicate as to which of the conditions did the petitioner violate for inviting such drastic action—the High Court held the impugned order of cancellation of the licence as illegal, thus, set aside—writ application allowed.
