Petitioner is that he is a licensed dealer and as such he was competent to keep the above said medicines - petition under section 482 Cr.P.C. for quashing of FIR No.475 dated 8.11.2012 under section 22/61/85 of the NDPS Act, registered at Police Station Narnaul-FIR was registered against the petitioner on the allegation that 174 boxes of lupegesic injections each containing 5x5x2 ml pouches were recovered from the shop of the petitioner containing Bupenorphine salt- the case of the petitioner is that he is a licensed dealer and as such he was competent to keep the above said medicines- since the petitioner was competent to keep the medicines recovered from him, he cannot be proceeded under section 22/61/85 if the NDPS Act. This actual position has not been disputed by the State counsel.
