Review Committee reported that no offence under Narcotics Drugs and Psychotropic Substances Act, 1985, is made out - the petitioner is proprietor of a Medicine/Chemist Shop- Drug Inspector apprehended the petitioner - some drugs and injections were recovered from the direct possession of the petitioner- the Review Committee reported that no offence under Narcotics Drugs and Psychotropic Substances Act, 1985, is made out. However, the provisions of Drugs & Cosmetics Act 1940 have been violated- FIR registered under NDPS Act quashed. However, the Drug Inspector left at liberty to proceed against the petitioner under the relevant provisions of the Drugs and Cosmetics Act - petition allowed.
